Terms of Service

1. Acceptance of Terms

By accessing or using Hima's Choice ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all visitors, users, and purchasers of our digital embroidery designs.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old or have parental consent to use the Platform.
  • One account per person. Multiple accounts may be deactivated.

3. Digital Product License

When you purchase an embroidery design from Hima's Choice, you receive a non-exclusive, non-transferable license to use the design file under the following terms:

  • Permitted: Use the design to create finished embroidered products for personal use or for sale.
  • Permitted: Resize or adjust stitch density for your specific machine.
  • Prohibited: Resell, redistribute, or share the digital design file itself.
  • Prohibited: Claim the design as your own original work.
  • Prohibited: Include the design file in any collection or bundle for resale.

4. Purchases and Payments

  • All prices are listed in Indian Rupees (INR) unless otherwise stated.
  • Payments are processed securely through Razorpay. By making a purchase, you also agree to Razorpay's terms of service.
  • You will receive instant access to download your purchased designs upon successful payment verification.
  • Design files remain accessible in your account library indefinitely after purchase.

5. Referral Program

  • Registered users may participate in our referral program to earn commissions on qualifying purchases made through their referral links.
  • Commission rates are set by Hima's Choice and may change at any time with notice.
  • Commissions are subject to review and approval before payout.
  • Self-referrals and fraudulent activity will result in account termination and forfeiture of unpaid commissions.
  • Minimum payout thresholds apply as configured in the program settings.

6. Creator / Artist Terms

If you are an approved creator selling designs on Hima's Choice:

  • You warrant that all designs you upload are your original work or that you have the rights to sell them.
  • You grant Hima's Choice a license to display, market, and distribute your designs through the Platform.
  • Earnings are paid according to the commission structure agreed upon during onboarding.
  • Hima's Choice reserves the right to remove designs that violate our quality standards or these terms.

7. Intellectual Property

The Hima's Choice platform, including its design, logo, text, and code, is the intellectual property of Hima's Choice. Individual embroidery designs are the intellectual property of their respective creators, licensed to buyers under the terms described in Section 3.

8. Prohibited Conduct

  • Attempting to access, tamper with, or use non-public areas of the Platform.
  • Using automated tools to scrape, download, or collect content from the Platform.
  • Interfering with or disrupting the integrity of the Platform or its servers.
  • Impersonating another user or misrepresenting your identity.
  • Uploading malicious files or content that infringes on the rights of others.

9. Limitation of Liability

Hima's Choice is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim related to the Platform shall not exceed the amount you paid for the specific product giving rise to the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. Upon termination, your license to access purchased designs remains valid, but you will lose access to the Platform's features. You may request account deletion at any time by contacting support.

11. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email to registered users. Continued use of the Platform after changes constitutes acceptance of the revised terms.
